Terms & Conditions

These Terms and Conditions ("Terms") govern your relationship with the operator of the website available via the domain chan-au.com in connection with your use of the services reviewed and described on Chan (the "Site"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must not use the Site. These Terms are effective as of 6 November 2025 and are deemed confirmed and applicable through at least 31 December 2026, unless replaced or updated in accordance with the "Changes to Terms" section below.

Definitions

For the purposes of these Terms, the following definitions apply. These definitions are intended to clarify your rights and obligations when using Chan in connection with the offshore casino services operated via chan-au.com.

  • "Site" means the review and informational website referred to as Chan, including all content accessible under the project domain chan-au.com, any related subdomains, and associated pages.
  • "Operator" means Dama N.V., a public limited company (N.V.) incorporated under the laws of Curaçao, with registered address at Scharlooweg 39, Willemstad, Curaçao, registration number 152125, holder and/or beneficiary of online gambling services operated under licence 8048/JAZ2020-013 issued via Antillephone N.V., and any authorised subsidiaries, including Strukin Ltd of Cyprus acting as a payments subsidiary, to the extent they are involved in providing or supporting services accessible through chan-au.com.
  • "User" means any person who accesses, browses, or otherwise uses the Site Chan, whether or not they create an account with the Operator.
  • "Player" means a User who has registered an online gambling account with the Operator through chan-au.com or any related mirror or regional domain and who participates in games or betting activities.
  • "Account" means a personal user profile created with the Operator through chan-au.com or any associated domain that allows a Player to deposit funds, place wagers, participate in games, and withdraw winnings, subject to these Terms and the Operator's internal rules.
  • "Services" means any gambling, gaming, betting, promotional, bonus, payment, account, or support services offered by the Operator via chan-au.com or any other domain mapped to the Chan brand that is accessible to Users, as reviewed or described on Chan.

  • "ACMA" means the Australian Communications and Media Authority, the regulator responsible for enforcing certain provisions of the IGA, including blocking of illegal offshore gambling websites.
  • "We", "us", and "our" refer to the Operator in the context of the Services, and where relevant, to the entity responsible for maintaining Chan as part of the chan-au.com project domain.
  • "You" and "your" refer to the User and/or Player, as the context requires.

Account Registration

This section describes the requirements and obligations relating to the creation and maintenance of an Account with the Operator through chan-au.com, as referenced and reviewed on Chan.

Eligibility and Age Requirements

  • Minimum age: You must be at least 18 years of age, or the age of legal majority in your country of residence (whichever is higher), to register an Account or use the gambling Services associated with chan-au.com. By registering, you warrant that you meet this requirement.
  • Legal capacity: You confirm that you have full legal capacity to enter into binding agreements under the laws applicable to you and that you are not subject to any legal restriction which would prohibit your participation in online gambling.
  • Australian restrictions: Australian Users are reminded that, although the Operator is licensed in Curaçao and operates offshore, the offering of certain interactive gambling services to persons in Australia may be restricted under the IGA. You are solely responsible for ensuring that your use of the Services does not violate Australian law or the law of your jurisdiction. Account Creation Process

  • Registration details: To create an Account, you must complete the online registration form on chan-au.com (or a related Mirror Domain) by providing accurate and complete personal information, which may include your full name, date of birth, country of residence, email address, phone number (if requested), and a chosen username and password.
  • Email verification: You may be required to verify your email address by clicking a confirmation link or entering a code sent to the email address you provided. Failure to complete this verification may result in limited functionality or suspension of Account activity.
  • Single account policy: You are permitted to hold only one Account with the Operator for the Chan brand and associated domains. Multiple registrations, use of aliases, or maintaining duplicate accounts for the purpose of bonus abuse or circumvention of restrictions is prohibited and may result in closure of all related accounts and confiscation of funds, subject to applicable law.

KYC and Verification

  • Identity verification: The Operator may at any time request documents to verify your identity, age, residence, and payment methods (for example, passport, national identity card, driver's licence, utility bill, bank statement, or payment card copy). You agree to provide such documents promptly and to ensure they are genuine and up to date.
  • Source of funds: Where necessary to comply with anti-money laundering and counter-terrorism financing obligations, the Operator may request additional information regarding the origin of your funds and wealth. Failure to provide satisfactory evidence may result in suspension or closure of your Account and reporting to relevant authorities.
  • Accuracy and updates: You are responsible for keeping your registration and KYC data accurate and current. If your details change, you must promptly update them in your Account profile or notify support at [email protected].

User Obligations and Account Security

  • Password security: You must keep your username, password, and any other access credentials confidential. You are solely responsible for all activity performed through your Account, whether or not authorised by you. If you suspect that your Account has been compromised, you must immediately change your password and notify support.
  • Prohibition on third-party use: You may not allow any third party to access or use your Account. You may not sell, transfer, or assign your Account to another person. Accounts created or used on behalf of third parties, including as agents or nominees, are prohibited.
  • Truthfulness of information: You warrant that all information you provide is true, complete, and not misleading. The Operator reserves the right to suspend or terminate your Account, void bets, and withhold withdrawals where false or misleading information has been supplied, subject to applicable law and fair treatment principles.

Betting & Gameplay Rules

This section sets out the principal rules that apply when you place Bets or participate in games through chan-au.com or associated domains, as referenced on Chan.

General Gameplay Principles

  • Game rules: Each game, event, or product (for example, slots, table games, live casino, and other interactive games) may have specific rules and instructions made available through the game interface or help section. By placing a Bet, you acknowledge that you have read and understood the relevant rules.
  • Fairness and RNG: The Operator uses random number generator (RNG) technology and/or third-party providers licensed by the Curaçao regulator or comparable bodies to ensure fair and random outcomes. Game results generated by the relevant software are final and binding, subject to the error and malfunction rules below.
  • Time of acceptance: A Bet is deemed accepted when it is registered as such on the Operator's servers. System logs maintained by the Operator or its game providers will be decisive in determining whether and when a Bet has been placed and the outcome recorded.

Types of Bets and Limits

  • Minimum and maximum stakes: Each game may specify a minimum and maximum Bet amount. You agree not to place Bets outside the displayed limits. Attempted Bets exceeding limits may be rejected or adjusted by the system without notice.
  • Currency and conversions: Bets must be placed in the currency(ies) accepted by the Operator for your Account. Where currency conversions occur, they are performed at rates determined by the Operator or its payment processors, and minor discrepancies or rounding differences may arise.
  • Bonus play: Bets funded by Bonuses or free spins may be subject to different maximum Bet limits and game restrictions. Placing Bets that exceed bonus-related maximums may result in forfeiture of bonus funds and derived winnings, as further described in the Bonus Terms.

Bet Cancellation and Modification

  • Irrevocability of Bets: Once a Bet has been accepted by the system, it generally cannot be cancelled or modified by the Player. You are responsible for ensuring that Bet details (game, amount, and other relevant settings) are correct before confirming.
  • Operator corrections: The Operator may cancel, void, or adjust Bets in the event of technical errors, incorrect odds or payouts, malfunctions, or where a game or round has clearly behaved contrary to its intended rules. In such cases, affected Bets may be rolled back, and your balance restored to the pre-bet position, or, where appropriate, adjusted in accordance with corrected outcomes.
  • Malfunction clause: In the event of a game malfunction, software error, or other defect interfering with the proper functioning of a game, all Bets and plays affected by that malfunction may be declared void at the Operator's discretion. Winnings obtained from such malfunctioning games may be cancelled, and any corresponding funds removed from your balance, subject to applicable law.

Responsible Participation

  • Regulatory context for Australian Users: Australian Users should be aware that the ACMA may request blocking of certain offshore gambling sites considered to be in breach of the IGA. Access to chan-au.com or related Mirror Domains may be restricted or blocked at the ISP level in Australia as noted in public ACMA communications, such as the article available at acma.gov.au regarding blocking of illegal gambling websites. Such blocking does not create any obligation on the Operator to compensate Users or maintain continuous availability of Services.

Bonus Terms

This section governs Bonuses and promotions made available by the Operator in connection with the Chan brand as presented through chan-au.com and reviewed on Chan.

Bonus Activation

  • Eligibility: Bonuses may be offered to new or existing Players at the Operator's discretion. Eligibility criteria can include geographic location, account status, deposit history, and compliance with these Terms. Certain Bonus offers may not be available to Australian Users depending on regulatory considerations.
  • Activation mechanics: A Bonus may require:
    • Entry of a bonus code during registration or deposit;
    • Selection of a promotion in the cashier or promotions section; or
    • Automatic crediting upon completion of qualifying actions (such as a first deposit).

Where evidence of such conduct exists, the Operator may cancel Bonuses and winnings and suspend the associated Accounts, subject to applicable law.

Combining Promotions and Cashback

  • No automatic stacking: Unless expressly and clearly permitted in the promotion description, Bonuses cannot be combined or "stacked" with other promotions, cashback offers, or VIP rewards on the same deposit or wagering period.
  • Cashback and loyalty: Cashback, loyalty points, and similar programs may be subject to their own conditions. If such programs interact with other Bonuses (for example, loyalty points earned during bonus play), the more specific promotion rules will prevail.
  • Bonus disputes: In the case of any dispute about the application, interpretation, or eligibility of a Bonus, the Operator's records and decision will be final, subject to your rights under applicable law and the dispute resolution mechanisms described in these Terms.

Payments & Withdrawals

This section outlines the methods and conditions for making deposits and withdrawals in connection with the Services accessed via chan-au.com, as referenced on Chan.

Deposit Methods

  • Available options: The Operator may offer various payment options, including but not limited to:
    • Debit and credit cards (where permitted under applicable law);
    • E-wallets and online payment services;
    • Bank transfers;
    • Cryptocurrencies, subject to availability and technical support.
    The exact methods available to you depend on your jurisdiction, account status, and the Operator's commercial arrangements.
  • Processing entity: Payments may be processed by Strukin Ltd (Cyprus) or other third-party payment processors acting on behalf of Dama N.V. as the Operator.
  • Limits and fees: Minimum and maximum deposit amounts, any applicable fees or surcharges, and processing times will be communicated in the cashier section or during the deposit process. The Operator may change these parameters at any time, provided existing deposits already initiated are processed under the conditions applied at the time of initiation.

Withdrawal Methods

  • General principle: Where possible, withdrawals will be processed using the same method and to the same account or instrument used for deposits, subject to technical feasibility, regulatory requirements, and anti-money laundering considerations.
  • Verification prior to payout: Before processing withdrawals, the Operator may require completion of KYC checks, including confirmation of identity, residence, and ownership of the payment method. Failure to complete verification may delay or prevent withdrawal.

Refunds and Reversals

Limitation of Liability

Operator's Obligations

Exclusions and Limitations

  • No liability for user conduct: You remain fully responsible for your own actions and decisions when using the Services, including compliance with local laws (such as the IGA in Australia), and for any losses arising from your gambling activities.
  • Technical failures: The Operator is not liable for technical failures, interruptions, delays, or malfunctions of hardware, software, networks, internet connectivity, or third-party systems, provided that such failures are not caused directly by the Operator's gross negligence or wilful misconduct.
  • Blocking by regulators or ISPs: The Operator is not liable for any losses, inconvenience, or inability to access the Site or Services resulting from actions by regulators (including ACMA), courts, or internet service providers, such as blocking orders or filtering of domains considered to offer illegal interactive gambling services to Australians.
  • Indirect and consequential losses: To the maximum extent permitted by applicable law, the Operator excludes liability for any indirect, incidental, special, consequential, or punitive damages, including loss of profit, loss of data, or loss of opportunity, even if foreseeable.

Maximum Compensation

  • Cap on liability: Where the Operator is found liable to you under applicable law, its aggregate liability shall, to the extent permitted, be limited to the lesser of:
    • The amount of the Bet or Wager that directly gave rise to the claim; or
    • The net amount of deposits made by you to your Account in the six (6) months preceding the event giving rise to the claim, after deducting any withdrawals already processed.
  • Non-excludable rights: Nothing in these Terms is intended to exclude or limit any non-excludable consumer rights or statutory guarantees that you may have under applicable law, including, where relevant, the Australian Consumer Law.

Intellectual Property Rights

Ownership of Content

You obtain no ownership rights in such software by using the Services; you only receive a limited licence to use it as necessary for participation in games, subject to these Terms.

Permitted and Prohibited Use

  • Limited licence: You are granted a non-exclusive, non-transferable, revocable licence to access and use Chan and the Services via chan-au.com for personal, non-commercial entertainment purposes only.
  • Prohibitions: You may not, without prior written consent:
    • Copy, reproduce, distribute, modify, adapt, translate, or create derivative works from any content on the Site;
    • Reverse engineer, decompile, or disassemble any software or attempt to access source code, except where permitted by mandatory law;
    • Use the Chan brand name, logos, or trademarks in connection with any other products, services, or domains.
  • Third-party content: Game providers' logos, trademarks, and other content remain the property of their respective owners and may not be used without their permission.

Privacy & Data Protection

This section highlights how personal data is handled in connection with Chan and the Services accessed through chan-au.com.

  • Privacy policy reference: All collection, processing, and storage of your personal data is governed by the Operator's Privacy Policy as published on chan-au.com (or any successor domain). By using the Site and Services, you acknowledge that you have read and understood that Privacy Policy.
  • Scope of data processing: The Operator may process identification data, contact information, transactional records, and technical usage data for purposes including account administration, KYC, anti-money laundering compliance, service provision, security, and regulatory reporting.
  • Data protection standards: While the Operator is established in Curaçao and its primary data processing obligations arise under Curaçao law and any contractual or licence conditions, it will take reasonable steps to protect your personal data against unauthorised access, loss, or misuse.
  • Australian considerations: Australian Users should note that their data may be transferred to and stored outside Australia, in jurisdictions that may not have the same level of data protection as Australian law. Changes to Terms

This section explains how these Terms may be updated and how you will be notified.

Amendment Procedure

  • Right to modify: The Operator reserves the right to amend, update, or replace these Terms at any time, including to reflect changes in applicable law (such as amendments to the IGA), regulatory guidance, licensing conditions, or operational requirements.
  • Notification methods: Material changes to these Terms will typically be communicated using one or more of the following methods:
    • Publication of the updated Terms on chan-au.com and/or Chan with an updated "effective date";
    • Display of an in-site notification or banner on login;
    • Sending a notice by email to the address associated with your Account.

Your Acceptance and Right to Discontinue Use

  • Deemed acceptance: If you continue to use the Site or Services after the updated Terms have become effective, you will be deemed to have accepted the changes.
  • Disagreement with changes: If you do not agree with any updated Terms, you must immediately cease using the Site and Services, and you may request closure of your Account in accordance with the Termination & Suspension section.
  • Historic versions: The Operator may, where reasonably practicable, retain or provide access to prior versions of the Terms for reference, but only the currently effective version will govern your use of the Site and Services.

Termination & Suspension

This section describes when and how your access to Chan and the Services via chan-au.com may be suspended or terminated.

Termination by You

  • Voluntary closure: You may request closure of your Account at any time by contacting customer support at [email protected] and following any verification steps required by the Operator.
  • Withdrawal of funds: Subject to completion of KYC and absence of legal or regulatory restrictions, you may withdraw any eligible real-money balance from your Account before closure. Any remaining Bonus funds or non-withdrawable balances may be forfeited upon closure, as specified in the Bonus Terms.

Suspension and Termination by the Operator

  • Grounds for action: The Operator may suspend or terminate your Account, or restrict your access to certain Services, where it reasonably suspects or determines that:
    • You have breached these Terms or any game or Bonus rules;
    • You have provided false, incomplete, or misleading information, or failed to complete KYC;
    • You are underage or otherwise ineligible to use the Services;
    • You have engaged in fraud, money laundering, collusion, or other unlawful or improper activity;
    • Your use of the Services may violate the laws of Australia (including the IGA) or another relevant jurisdiction; or
    • A competent authority, such as ACMA, has taken steps that affect the legality or practical availability of the Services to you.
  • Consequences: During suspension, you may be prevented from placing Bets, receiving Bonuses, or making withdrawals. In cases of confirmed serious breach or illegality, the Operator may close your Account and, where permitted by law, void Bets, confiscate funds related to unlawful or abusive activity, and report the matter to relevant authorities.
  • Refund of legitimate funds: Where your Account is terminated for reasons other than serious breach, fraud, or illegality, the Operator will, subject to KYC completion and any legal restrictions, endeavour to pay out any remaining real-money balance to you using a mutually acceptable method.

Notice

  • Notification of action: Where legally and practically possible, the Operator will inform you of any suspension or termination of your Account via email or on-site notification, stating the main reasons for the action and providing information on how you may contact support to seek clarification or raise objections.
  • Immediate action: In circumstances involving suspected fraud, money laundering, or other serious risks, the Operator may act without prior notice if it considers that immediate suspension is necessary to protect Users, the Operator, or the integrity of the Services.

Governing Law & Jurisdiction

This section specifies the laws that govern these Terms and the mechanisms for resolving disputes.

Applicable Law

  • Primary governing law: These Terms, and any contractual relationship between you and the Operator relating to Chan and the Services accessed through chan-au.com, are governed by and construed in accordance with the laws of Curaçao, without prejudice to any mandatory provisions of law that may apply in your country of residence.
  • Australian regulatory overlay: For Australian Users, the IGA and associated regulatory measures, including ACMA's blocking powers, may apply in parallel. Nothing in these Terms is intended to override mandatory provisions of Australian law that apply to you as a matter of public order.

Dispute Resolution

  • Internal complaint process: If you have a complaint regarding the Site or Services, you should first contact customer support at [email protected], providing a clear description of the issue, relevant dates, and any supporting documentation. The Operator will endeavour to respond within a reasonable time and to resolve the matter amicably.
  • External escalation: If a dispute cannot be resolved through the internal process, you may have the option to refer the dispute to an independent dispute resolution body or apply to the competent courts of Curaçao, depending on the nature of the dispute and applicable law. Details of any available alternative dispute resolution mechanisms may be provided by the Operator upon request.
